In a recent engagement with one of our clients—a prominent manufacturer and distributor of consumer goods in the United States—John demonstrated his keen analytical skills and industry knowledge. During routine collaboration between our sales tax compliance team and the client, we identified unusual activity that warranted further investigation. Specifically, we noticed a spike in use tax in one state followed by a corresponding spike in sales tax in another state in the subsequent reporting period.

With this insight, John meticulously analyzed the situation and discovered a significant overpayment of use tax that had occurred due to a misunderstanding of tax obligations related to promotional giveaways. The client had withdrawn inventory items for use as promotional giveaways at a tradeshow. Typically, items withdrawn from inventory for such purposes are subject to use tax in the state where they are utilized. However, after the tradeshow, the remaining inventory was shipped to one of the client’s outlet stores in a different state, where it was sold at retail, and sales tax was collected and remitted.

The client initially viewed these transactions as separate and unrelated. However, John recognized an opportunity to recover the use tax associated with the inventory that was ultimately sold. His expert analysis revealed that while the “accrue on withdrawal” approach is a standard practice for normal sales promotions, it did not apply in this case. The inventory, still available for sale after the tradeshow, should not have been subject to use tax.
